These Terms of Use (the “Terms”) set forth the terms and conditions governing the use of the iOS application “Tococo” (the “App”) provided by Kyosuke Watanabe (the “Provider”). All users of the App must agree to these Terms before using the App.

Article 1 (Application of These Terms)

  1. These Terms apply to all matters relating to the use of the App between users and the Provider.
  2. Any notices, guidelines, specific terms, or other rules regarding use of the App that the Provider makes available within the App, on the Provider’s website, or by any other means shall constitute part of these Terms.
  3. If there is any inconsistency between these Terms and any specific terms or rules referred to in the preceding paragraph, such specific terms or rules shall prevail.
  4. If the App is obtained and used through the App Store, Apple’s applicable terms and conditions and other rules shall apply in addition to these Terms.

Article 2 (Definitions)

For purposes of these Terms, the following terms shall have the meanings set forth below:

  1. “User” means any individual who uses the App.
  2. “Free Plan” means the range of features of the App that are available free of charge.
  3. “Plus Plan” means a paid plan that provides access to additional features of the App.
  4. “Subscription Plan” means an automatically renewing Plus Plan offered on a monthly or annual basis.
  5. “One-Time Purchase Plan” means a paid plan that, through a single purchase, allows continued use of the Plus Features covered by the plan at the time of purchase.
  6. “Plus Features” means the paid features specified in Article 4 and any other features designated by the Provider as part of the Plus Plan within the App or on the App Store.

Article 3 (License to Use the App)

  1. Subject to compliance with these Terms, the Provider grants each User a non-transferable, non-sublicensable, non-exclusive right to use the App for personal, non-commercial purposes.
  2. Users are responsible, at their own expense, for providing and maintaining the iPhone or other device, internet or other communications environment, electricity, and any other equipment or environment necessary to use the App.
  3. The App does not require users to register for an account with the Provider. Users shall use the App in accordance with the environment associated with their device, Apple Account, and other applicable services.
  4. The license granted under this Article is subject to the terms and conditions applicable to the App Store and any other terms established by Apple.
